1. Introduction
Welcome to AuditWeb.cloud (“Service”, “we”, “us”, or “our”). These Terms & Conditions govern your use of the AuditWeb.cloud website and services operated by AuditWeb, based in Romania, European Union.
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
2. Service Description
AuditWeb.cloud is a Software-as-a-Service (SaaS) platform that provides automated website audits. Our tool analyzes websites for performance, accessibility, SEO, security, and other quality metrics using technologies including Google PageSpeed Insights API and AI-powered analysis via OpenRouter.
Audit results are generated automatically and are provided for informational purposes only. They do not constitute professional consulting advice. We strive for accuracy but do not guarantee that all findings or recommendations are complete or error-free.
3. User Accounts
To access certain features of the Service, you must create an account by providing your name, email address, and a password. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activities that occur under your account.
- Providing accurate and up-to-date information.
- Notifying us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or are used for unauthorized purposes.
4. Acceptable Use
You agree not to use the Service to:
- Audit websites you do not own or have authorization to audit.
- Attempt to overload, disrupt, or exploit the Service infrastructure.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Resell, redistribute, or sublicense audit results for commercial purposes without our written consent.
- Use automated scripts or bots to access the Service beyond the intended API usage.
- Violate any applicable laws or regulations.
5. Credits and Payments
AuditWeb.cloud operates on a credit-based system. Credits are required to perform website audits.
- Pricing: All prices are displayed in EUR (Euros) and include applicable taxes unless otherwise stated.
- Payment Processing: Payments are securely processed by Stripe, a PCI-DSS compliant payment processor. We do not store your full credit card details on our servers.
- Credit Validity: Purchased credits do not expire unless your account is terminated for a violation of these Terms.
- Refunds: Due to the digital nature of our Service, refunds are generally not provided for used credits. Unused credits may be eligible for a refund within 14 days of purchase, in accordance with EU consumer protection regulations. Refund requests should be sent to contact@auditweb.cloud.
- Free Credits: We may offer free credits for new accounts or promotions. Free credits may have different terms and expiration dates, which will be communicated at the time of issuance.
6. Intellectual Property
The Service, including its original content, features, functionality, design, and underlying technology, is and remains the exclusive property of AuditWeb and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws of Romania and the European Union.
Audit reports generated for your account are licensed to you for your personal or internal business use. You may share audit reports with third parties (e.g., clients) but may not resell the Service itself or misrepresent audit reports as your own proprietary technology.
7. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied.
- We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
- Our total liability for any claims arising from or related to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.
Nothing in these Terms excludes or limits our liability for matters that cannot be excluded or limited under applicable EU or Romanian law, including liability for fraud or gross negligence.
8. Service Availability and Modifications
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes that may affect their use of the Service.
We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
9. Termination
You may terminate your account at any time by contacting us at contact@auditweb.cloud. Upon termination, your right to use the Service will cease immediately. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.
We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or engage in conduct that we determine, at our sole discretion, to be harmful to the Service or other users.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Romania and applicable European Union regulations, without regard to conflict of law provisions.
Any disputes arising from or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to the competent courts of Romania.
If you are a consumer within the European Union, you may also be entitled to use the European Commission's Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr.
11. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
